The content of this data protection declaration is information about which personal data we store, process and use during the application process.
1. Definition of personal data
Personal data is information that relates to an identified or identifiable person. This includes, above all, information that allows conclusions to be drawn about your identity, for example your name, your telephone number, your address or e-mail address.
2. Collection and processing of personal data
If you provide us with personal data as part of the application process, this will be divided into the following data types and data categories for collection, processing and/or use:
- Personal data (first and last name, date of birth, address, school education)
- Communication data (phone number, mobile number, fax number, e-mail address)
- Information supply (by third parties, such as credit agencies or from public directories)
- Data on the assessment and evaluation in the application process
- Data on education (school, vocational training, civil/military service, degree, doctorate)
- Data from previous career path, training and working certificates
- Information on other qualifications (e.g. language skills, computer skills, volunteer activities)
- Application photo
- Application history
3. Use and disclosure of personal data
We use the personal data you provide exclusively for processing your application for the advertised position. Your personal data will only be disclosed to persons involved in the application process. All employees entrusted with data processing are obliged to maintain the confidentiality of your data. We do not pass on your personal data to third parties unless you have consented to the passing on of data or we are obliged to pass on data due to legal provisions and/or official or court orders. An application creates an account in our portal.
4. Commissioned data processing
Based on a separate agreement on the processing of personal data on behalf, your personal data will be collected, processed and used by consultfox, within the scope of commissioned data processing pursuant to Art. 28 DSGVO in accordance with the legal requirements.
A processor is a natural or legal person, an authority, institution or other body that processes personal data on behalf of the controller. The processor is not a "third party" within the meaning of the General Data Protection Regulation.
5. Data retention and deletion
Your data will be deleted automatically as soon as the application process gets completed successfully. This shall not apply if statutory provisions prevention such a deletion, if continued storage is necessary for the purpose of proof or if you have expressly consented to a longer storage period.
6. Talent Pool / Unsolicited application
If you opt to be added to the Talent Pool (unsolicited application), in the event of vacancies, the entire company may gain access to your personal access data. Each unsolicited application is automatically added to the talent pool.
7. Security
We will take all the necessary technical and organisational security measures to protect your personal data against loss or misuse. As such, your data will be stored in a secure operating environment which is not accessible to the public.
8. Data subject rights
In order to assert your rights described here, you can contact us at any time at info@consultfox.de.
When doing so, please ensure that we are able to clearly identify you. You have the following data subject rights under the respective legal conditions:
a) Right to information (Article 15 DSGVO, Section 34 BDSG)
According to Art. 15 DS-GVO, you can request information about your data processed by us. In particular, you can request information about the processing purposes, the category of data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right of complaint, the origin of your data if it has not been collected by us, as well as the existence of automated decision-making including profiling and, if applicable, meaningful information about its details.
b) Right to rectification (Article 16 DSGVO, Section 34 BDSG)
Pursuant to Article 16 DS-GVO, you may immediately request the correction of incorrect or the completion of your data stored by us.
c) Right to deletion (Article 17 DSGVO, § 35 BDSG)
Pursuant to Article 17 DS-GVO, you may request the deletion of your data stored by us, unless the processing is necessary for the exercise of the right to freedom of expression and information, for the fulfilment of a legal obligation, for reasons of public interest or for the assertion, exercise or defense of legal claims.
You can request that we delete your data in the following cases:
- your personal data is no longer needed for the purposes for which it was collected
- the legal basis for the processing was solely your consent and you have revoked this consent
- You have objected to processing on the legal basis of legitimate interest on personal grounds and we have not been able to demonstrate that there are overriding legitimate grounds for processing
- Your personal data has been processed unlawfully; or
- Your personal data must be erased to comply with legal requirements
d) Right to restriction of processing (Article 18 DSGVO)
According to Article 18 DS-GVO, you may request the restriction of the processing of your data insofar as the accuracy of the data is contested by you or the processing is unlawful. This is particularly the case if
- the accuracy of your personal data is disputed by you, and then until we have had the opportunity to verify the accuracy
- the processing is not lawful and you request restriction of use instead of erasure (see previous section)
- we no longer need your data for the purposes of processing, but you need it to assert, exercise or defend your legal claims
Where there is a right to restrict processing, we mark the data concerned to ensure that it is only processed within the narrow limits that apply to such restricted data (namely, in particular, for the defense of legal claims or with your consent).
e) Right to data portability (Article 20 DSGVO)
Pursuant to Article 20 DS-GVO, you may receive your data that you have provided to us in a structured, commonly used and machine-readable format or request that it be transferred to another controller ("data portability").
f) Right to withdraw consent (Article 7(3) DSGVO)
Pursuant to Article 7(3) DS-GVO, you may revoke your consent, once given, at any time vis-à-vis us, if you have given such consent. This has the consequence that we may no longer continue the data processing based on this consent for the future. Consent is your voluntary will, made intelligible in an informed and unambiguous manner by a statement or other unambiguous affirmative act, that you agree to the processing of the personal data concerned for one or more specific purposes.
